On January 8, the Seoul court has judged that the Japanese government is liable to compensate for Japanese Military Sexual Slavery, ordering it to give 100 million won ($=91500) to each victim. It is the first ruling that the national court recognize a liability of reparation from Japanese government. The Seoul Central District Court said that State immunity cannot be applied to crimes against humanity.

The situation began when Japanese militaries committed slavery to the 12 so-called comfort women, including the late Bae Choon-hee, who sued the Japanese government for 100 million per person in damages in August 2013. After the Japanese government refused to mediate, the victims filed a lawsuit within the country in October 2015. The court accepted their request and allocated the case to the Seoul Central District Court in January 2016. However, the trial was delayed for four years because the Japanese government refused to cooperate. In January 2020, the victims including Bae and others had their cases heard in a total of four trials.


When the trial began, the Japanese government insisted that the lawsuit should be dismissed without attending the court, citing the principle of national immunity, an international corporation that one country's court cannot judge another country as a litigant. In response, the court said on Friday that illegal activities, in this case, are planned and organized anti-humanitarian acts that violate international norms, and that national exemptions such as state exemptions do not ally. The court said the plaintiffs suffered an unimaginable amount of mental and physical pain and received no international apology.

Despite the court ruling; however, the Japanese government does not seem likely to pay for the victims. Japan's Chief Cabinet Secretary, Kato Katsunobu said in a regular press conference it is very regrettable that such a ruling has been made. He also added it is never acceptable. Moreover, he said that as a country, he will strongly demand that South Korea took appropriate measures to correct international law violations and he has no intention of appealing the first trial because he cannot recognize South Korea's jurisdiction in accordance with the principle of sovereignty exemption.


Relations between South Korea and Japan are expected to worsen. It is important for the government to take action to improve the Korea-Japan relationship.
